Buying a pre-construction home in the GTA: what to know
A freehold purchase agreement is a different document from a condo agreement: no statutory cooling-off period, lot premiums on top of the base price, a decor appointment for finishes, and Tarion coverage that includes protection against delayed closing. These are the terms to read closely.
Deposits on a freehold home
Freehold townhome and detached builders in the GTA usually collect the deposit in a short ladder, often 10 to 20 percent across a handful of instalments in the first year, with the balance due on closing. Deposits are held in trust and protected through Tarion up to the statutory limit. Of the 478 projects we track in the GTA, 194 are selling now, with a median published starting price of $1,159,990.
Lot premiums, upgrades and development charges
The published starting price is for a base lot and standard finishes. Corner, ravine, pie-shaped and walk-out lots carry premiums, structural options are chosen at signing, and finish upgrades are selected at a decor appointment several months before closing. Development charges and educational levies are frequently passed through as closing adjustments, so a cap on those adjustments is one of the most valuable clauses to negotiate.
No statutory cooling-off on freehold
Ontario's 10-day rescission period comes from the Condominium Act and applies to condominiums only. A freehold agreement of purchase and sale is binding once both parties sign, so lawyer review, financing confirmation and a read of the builder's schedules should happen before signing, not after. Condominium townhomes are the exception: they follow the condo rules, including the cooling-off period.
Tarion warranty and delayed-closing protection
Every new home built by a licensed builder in Ontario is enrolled with Tarion. Coverage includes deposit protection, compensation when closing is delayed beyond the critical dates set out in the agreement, and warranties of one year on workmanship and materials, two years on building systems and seven years on major structural defects. Across the GTA the projects we track are currently scheduled to occupy in 2025 (74), 2026 (34), 2027 (16), 2028 (7), 2029 (1).
Closing costs and HST
A freehold home closes in a single step when the house is complete, with title, mortgage funds and possession all on the same day. Ontario land transfer tax applies province-wide, and purchases inside the City of Toronto also pay Toronto's municipal land transfer tax; first-time buyers can claim rebates on both. New construction attracts HST. End users assign the federal and Ontario new housing rebates to the builder, so the advertised price is usually net of them; investors pay the rebate portion at closing and recover it through the new residential rental property rebate after leasing the unit for a year. Budget separately for legal fees, utility connections and the adjustments for development charges and levies, and ask for those adjustments to be capped in the agreement.
